Preliminary Provisions

This Shipping, Fulfillment and Delivery Policy (the “Policy”) delineates the terms, procedural conditions and operational limitations governing the processing, fulfillment, dispatch, carriage and delivery of merchandise purchased through Golden-Hour.shop.

For the purposes of this Policy, the expressions “Golden Hour,” “we,” “us” and “our” shall denote the merchant operating Golden-Hour.shop under the legal identity disclosed in the separately maintained Legal Notice. The expressions “customer,” “purchaser,” “you” and “your” shall denote the natural person or legal entity by whom, or on whose behalf, an order is submitted.

This Policy applies exclusively to physical merchandise purchased through Golden-Hour.shop and shall be construed in conjunction with the Terms of Service, Return and Refund Policy, Privacy Policy, Legal Notice and any product-specific, cart-specific or checkout-specific disclosure presented in connection with the relevant transaction.

In the event of an irreconcilable inconsistency between any provision of this Policy and a mandatory provision of applicable law, the latter shall prevail solely to the extent necessary to remedy that inconsistency. Nothing contained herein shall be construed as excluding, restricting, derogating from or prospectively waiving any right, remedy, obligation or liability that is incapable of lawful exclusion, restriction, derogation or waiver.

Geographical Scope Of Delivery

Golden Hour accepts orders solely for delivery to United States addresses recognized and accepted by the checkout interface at the time the relevant order is submitted.

The technical acceptance of an address by the checkout system shall not constitute an unconditional representation, warranty or undertaking that every item displayed on Golden-Hour.shop is capable of being delivered to that address.

Delivery eligibility may be restricted by reference to, inter alia:

the nature or characteristics of the merchandise ordered;

the customer’s state, territory, ZIP code or geographical location;

carrier-service limitations;

fulfillment-network availability;

legal, regulatory or customs restrictions;

remote-area service limitations;

address-verification outcomes;

package dimensions or transportation characteristics;

the operational capabilities of the relevant supplier or warehouse; and

the availability of an appropriate last-mile carrier.

Additional or distinct restrictions may apply to Alaska, Hawaii, United States territories, P.O. boxes, APO addresses, FPO addresses, DPO addresses and other military, remote, restricted or inadequately serviced locations.

Where Golden Hour determines, subsequent to receipt of an order, that the relevant merchandise cannot reasonably or lawfully be delivered to the submitted address, Golden Hour may cancel the affected merchandise or the order in its entirety and shall provide such refund as may be required under this Policy or applicable law.

Golden Hour does not undertake to deliver merchandise to destinations outside the United States unless such destination has expressly been made available through the checkout interface.

Distributed Fulfillment Arrangements

Golden Hour operates through a geographically distributed and internationally constituted fulfillment model involving independent manufacturers, suppliers, sourcing agents, fulfillment facilities, consolidation centers, customs intermediaries, freight operators, postal operators and commercial carriers.

Merchandise may accordingly be stored, processed, prepared, packaged and dispatched by an independent fulfillment participant rather than from premises owned, leased or directly operated by Golden Hour.

Depending upon the product, inventory allocation, supplier availability and delivery destination, merchandise may be dispatched from a location situated either within or outside the United States, including, without limitation, from fulfillment facilities situated in Asia.

A shipment may pass through one or more:

export-processing facilities;

international consolidation centers;

customs-clearance locations;

freight terminals;

transportation hubs;

regional sorting facilities;

postal networks; and

domestic last-mile carriers.

Consequently, the place of dispatch, sender designation, package documentation, return address, tracking domain, carrier identity or logistical reference appearing in connection with a shipment may differ from the legal, administrative or commercial location of Golden Hour.

The engagement of any third-party fulfillment participant shall not, of itself, require the customer to pursue such participant as the customer’s exclusive source of recourse in respect of an order for which Golden Hour remains legally responsible.

Receipt, Review And Acceptance Of Orders

An automated order-confirmation communication constitutes acknowledgment of electronic receipt only. It shall not constitute an unconditional acceptance of the order, confirmation of inventory availability or irrevocable undertaking to fulfill the transaction.

An order may be subjected to payment authorization, fraud screening, inventory confirmation, supplier confirmation, address verification, product-availability review and such other administrative, legal or operational checks as Golden Hour reasonably considers appropriate.

For the purpose of determining the commencement of an applicable shipment period, a properly completed order shall ordinarily be regarded as having been received when:

valid payment authorization has been obtained;

all information reasonably necessary for processing and fulfillment has been supplied;

no material discrepancy requiring clarification remains within the order information; and

the order is not contingent upon additional information, documentation or action requested from the customer.

A delay in the internal settlement of funds, transfer of a payment-processor balance, receipt of a merchant payout, payment of a supplier, reconciliation of accounts or receipt of funds within Golden Hour’s banking account shall not, of itself, postpone the commencement of an otherwise applicable shipment period.

Golden Hour may decline, suspend or cancel an order where reasonably necessary, including in circumstances involving suspected fraud, unauthorized payment, manifest pricing error, material product-description error, legal restriction, unavailable inventory, supplier non-performance or inability to complete fulfillment.

Where a charged order or item is cancelled, the relevant amount shall be refunded in accordance with the provisions of this Policy and applicable law.

Processing And Shipment Periods

Processing may comprise order verification, inventory allocation, sourcing, supplier confirmation, quality-control procedures where available, packaging, export preparation and the physical transfer of merchandise into the possession of a carrier.

The shipment period applicable to an order shall be the period clearly communicated on the relevant product page, within the checkout process, in the order confirmation or through another pre-purchase disclosure expressly applicable to the transaction.

Unless expressly stated otherwise before payment, any processing period described in connection with an order shall form part of, and shall not be additional to, the stated shipment period.

Where no shipment period has been clearly communicated, Golden Hour shall, subject to applicable law:

place the merchandise in the physical possession of a carrier within 30 days following receipt of the properly completed order;

transmit an appropriate shipping-delay communication within the applicable period; or

cancel the affected merchandise and initiate the applicable refund.

For the purposes of this Policy, merchandise shall not be deemed “shipped,” “dispatched” or otherwise transferred into carriage merely because:

a shipping label has been generated;

a tracking identifier has been assigned;

electronic shipment information has been transmitted;

a supplier has designated the order as fulfilled;

an order-status page has been updated;

customs documentation has been prepared; or

the customer has received a shipment-related communication.

Shipment shall be regarded as having occurred only when the merchandise has been placed in the physical possession of the carrier responsible for commencing its transportation.

Unless otherwise expressly specified, references to “business days” shall mean Monday through Friday, excluding relevant public holidays, banking holidays and material carrier or fulfillment closures.

Delivery Projections And Non-Guaranteed Dates

Any delivery date, delivery range or transit estimate communicated by Golden Hour shall constitute a good-faith projection derived from information made available by suppliers, fulfillment participants, logistics providers and carriers.

Except where a delivery service has been expressly identified in writing during checkout as incorporating a guaranteed delivery commitment, no projected delivery date or range shall constitute a warranty, condition or undertaking that delivery will occur on or before a particular calendar date.

Projected delivery may be affected by circumstances including, without limitation:

customs review, examination or clearance;

international transportation schedules;

carrier congestion;

peak-volume conditions;

adverse weather;

natural disasters;

governmental intervention;

labor disruption;

transportation interruption;

regional service limitations;

inaccurate carrier scanning;

address-verification issues;

last-mile delivery conditions;

supplier or warehouse closure;

public holidays;

security review; and

other circumstances not reasonably susceptible to Golden Hour’s direct control.

The occurrence of any such circumstance shall not extinguish any delay-notification, cancellation, refund or other obligation imposed by applicable law.

Unless an express written delivery guarantee has been provided during checkout, customers should not purchase merchandise in reliance upon its arrival before a wedding, holiday, journey, birthday, ceremony, professional engagement or other date-sensitive occasion.

Golden Hour shall not be responsible for a customer’s unilateral assumption that a non-guaranteed delivery projection constitutes an assured arrival date.

Shipping Charges And Promotional Shipping

Any shipping charge payable in respect of an order shall be disclosed before the customer submits payment.

The calculation of shipping charges may take account of destination, merchandise composition, package characteristics, available carrier services, promotional eligibility and such other logistical considerations as may reasonably be relevant.

Golden Hour may, without thereby assuming an obligation to continue doing so, offer complimentary, discounted or otherwise promotional shipping subject to the conditions stated on the website or during checkout.

The division of a single order into multiple packages at Golden Hour’s election shall not, of itself, result in the imposition of additional shipping charges upon the customer.

Tracking Information

Where made available by the relevant logistics network, tracking information shall be communicated to the email address associated with the order or made accessible through an order-status interface.

Tracking information is generated, transmitted and updated by third-party logistics providers. Golden Hour does not exercise direct control over the timing, frequency, terminology, geographical precision or technical accuracy of carrier-generated tracking events.

Tracking information may therefore:

become active only after an interval;

remain unchanged during physical transit;

contain limited information during international carriage;

display pre-transit information pending carrier acceptance;

change when custody is transferred between carriers;

reflect a foreign carrier before assignment to a domestic carrier;

contain an inaccurate or prematurely recorded event; or

appear in a language or format determined by the relevant carrier.

The absence of a recent tracking event shall not, standing alone, constitute conclusive evidence that a shipment has been lost.

Golden Hour does not undertake to use any particular carrier unless the customer has expressly purchased a service specifically identified by carrier and service level during checkout.

Severable, Partial And Multiple Shipments

Golden Hour may fulfill an order through more than one package or shipment where the ordered merchandise is held at different locations, administered by different suppliers or otherwise incapable of efficient consolidated fulfillment.

A customer may accordingly receive:

separate packages;

separate shipment communications;

different tracking identifiers;

different carrier information;

different dispatch locations; and

deliveries occurring on different dates.

Receipt of fewer than all ordered items shall not, without further confirmation from Golden Hour, constitute evidence that the outstanding merchandise has been cancelled.

The customer shall not incur additional shipping charges solely by reason of Golden Hour’s decision to divide the order into multiple shipments.

Inventory Availability And Substitute Merchandise

Inventory information may change following submission of an order as a consequence of supplier allocation, concurrent purchasing activity, inventory discrepancy, production discontinuation or other fulfillment conditions.

Golden Hour shall not knowingly substitute materially different merchandise without obtaining the customer’s express agreement where such agreement is required.

A difference may be considered material where it relates to, inter alia:

product category;

principal design;

color;

material or fiber composition;

size;

advertised function;

significant construction;

price; or

another characteristic reasonably capable of influencing the purchasing decision.

Where ordered merchandise is unavailable, Golden Hour may:

cancel and refund the unavailable merchandise;

invite the customer to consent to an applicable delay;

offer a specifically described substitute, which the customer may accept or reject; or

dispatch the available merchandise and refund the unavailable merchandise.

No customer shall be obligated to accept substitute merchandise merely because it is represented as comparable, equivalent or of greater retail value.

Delay-Option Procedure

Where Golden Hour ascertains that merchandise cannot be shipped within the applicable shipment period, Golden Hour shall, within the period required by applicable law, either cancel the affected merchandise and initiate the applicable refund or communicate an appropriate delay option to the customer.

A delay-option communication may specify:

the affected order or merchandise;

a definite revised shipment date for which Golden Hour possesses a reasonable factual basis;

where no such basis exists, a statement that a definite revised shipment date cannot presently be provided;

the reason for an indefinite delay where such explanation is required;

the customer’s right or option to consent to the delay;

the customer’s right or option to cancel and obtain a full and prompt refund;

the consequences of failing to respond; and

a cost-free method through which the customer may communicate the relevant election.

The legal consequences of customer non-response may depend upon the duration and nature of the proposed delay and shall be administered in accordance with applicable law.

Where affirmative consent to a delay is legally required and has not been obtained, Golden Hour shall cancel the unshipped merchandise and initiate the applicable refund.

If Golden Hour subsequently determines that shipment cannot be completed by a revised shipment date previously communicated to or accepted by the customer, Golden Hour shall obtain such further consent as may be required or cancel and refund the affected unshipped merchandise.

A customer who has affirmatively consented to an indefinite delay may cancel the affected merchandise at any time prior to actual shipment.

Refunds Relating To Unshipped Merchandise

Where Golden Hour is required to refund merchandise that has not been shipped, the refund shall be made to the original payment method unless that method is unavailable and another legally permissible method is required.

A mandatory monetary refund shall not be replaced exclusively by store credit, a voucher, promotional balance or gift card without the customer’s agreement where such substitution would be inconsistent with applicable law.

Where an order is cancelled in its entirety prior to shipment, the refund shall include the merchandise price and such shipping, handling, insurance or other order-level charges as are required to be refunded.

Where an order has been partially shipped, the refund shall include the amount attributable to the unshipped merchandise and such corresponding charges as are refundable by reference to the manner in which those charges were originally calculated.

Golden Hour shall initiate a legally required prompt refund within the period prescribed by applicable law. Where the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule applies, a Rule-mandated refund will ordinarily be transmitted within seven working days after the customer’s right to the refund arises, subject to the payment classification and other provisions of that Rule.

A bank, card issuer or payment provider may require additional time to post or display a refund after Golden Hour has transmitted it. Such external processing time is not controlled by Golden Hour.

Customer-Initiated Cancellations And Order Modifications

A request to cancel or modify an order, including a request concerning size, color, product selection or delivery address, should be submitted without delay through the official Contact page:

Because order information may be transmitted electronically to a supplier or fulfillment participant shortly after purchase, Golden Hour cannot undertake that a voluntarily requested modification or cancellation will remain operationally possible after processing has commenced.

A cancellation or modification request shall not be regarded as accepted unless and until Golden Hour has confirmed its acceptance in writing.

Where merchandise has already been shipped, any subsequent request to return the merchandise shall be administered under the Return and Refund Policy.

Nothing in this section shall restrict a cancellation right arising from a legally regulated shipping delay or any other non-waivable statutory entitlement.

Customer-Supplied Delivery Information

The customer is responsible for supplying accurate, current and complete delivery information, including, where applicable:

the recipient’s name;

street name and number;

apartment, suite or unit designation;

municipality;

state;

ZIP code;

access instructions; and

such other information as may reasonably be required for delivery.

Golden Hour may attempt to amend delivery information where a request is received sufficiently promptly, but no amendment is guaranteed after processing or fulfillment has commenced.

Where Golden Hour has expressly confirmed in writing that an address amendment has been completed, but the merchandise is subsequently sent to the superseded address as a result of an error attributable to Golden Hour or its fulfillment participant, Golden Hour shall investigate the circumstances and provide such remedy as is appropriate under this Policy and applicable law.

Where merchandise is shipped to the exact address supplied or subsequently approved by the customer, Golden Hour shall not be responsible for a delivery failure caused exclusively by the inaccuracy, incompleteness or obsolescence of that customer-supplied information.

Undeliverable, Refused, Unclaimed Or Returned Shipments

A shipment may be refused, held, abandoned, returned, destroyed or otherwise rendered undeliverable as a result of:

incomplete or inaccurate delivery information;

absence or unavailability of the recipient;

refusal of delivery;

failure to collect the package;

restricted access to the delivery premises;

unsuccessful delivery attempts;

a customs or carrier requirement;

failure to respond to a carrier communication; or

another circumstance attributable to the recipient or delivery location.

Where a shipment is returned or otherwise becomes undeliverable due to a customer-supplied address error or another circumstance attributable to the customer, Golden Hour may, according to the circumstances, offer:

reshipment following payment of the actual additional cost incurred;

a refund following receipt and processing of the returned merchandise; or

another reasonable resolution having regard to the carrier’s final disposition of the package.

To the extent legally permissible and adequately disclosed, actual non-refundable outbound transportation, return transportation, customs, carrier or handling costs caused by the customer may be deducted from an otherwise applicable refund.

Golden Hour shall not impose an arbitrary penalty or deduct costs caused by an error attributable to Golden Hour, its supplier or its carrier.

Customers are requested not to refuse delivery without first contacting Golden Hour, except where refusal is reasonably necessary because the package is visibly unsafe, materially damaged or accompanied by an undisclosed demand for payment.

Allegedly Lost Shipments

A shipment shall not be deemed lost solely by reason of a delayed, incomplete or temporarily inactive tracking history.

A customer who believes that merchandise has been lost should submit a sufficiently detailed inquiry through:

golden-hour.shop/pages/contact

Golden Hour may examine, among other evidence:

tracking history;

carrier-acceptance events;

customs status;

address information;

transfer records;

delivery scans;

delivery photographs;

geolocation information where available;

last-mile carrier records; and

information supplied by the customer.

The customer may be required to cooperate reasonably with a carrier, insurer, payment provider or fulfillment-partner investigation.

Where a shipment is confirmed to have been lost in transit or misdelivered through no fault attributable to the customer, Golden Hour shall provide an appropriate remedy, which may comprise:

replacement without an additional merchandise or shipping charge; or

refund to the original payment method.

Where Golden Hour remains legally responsible for a confirmed loss, the customer shall not be required to pursue the carrier as the customer’s sole remedy.

Shipments Recorded As Delivered But Not Located

Where carrier tracking records a shipment as delivered but the customer cannot locate it, the customer should promptly:

verify the delivery address stated in the order;

examine entrances, porches, garages, mailrooms, reception areas, parcel lockers and other customary delivery locations;

inquire with household members, neighbors, building personnel or reception staff;

review any carrier notice or delivery communication; and

notify Golden Hour, preferably within seven days following the recorded delivery event.

The foregoing seven-day period constitutes a recommended notification period for investigatory purposes and shall not extinguish a right that cannot lawfully be made subject to that period.

Golden Hour may commence an investigation and assess the available carrier and delivery evidence.

Where the available evidence demonstrates that the shipment was delivered to an incorrect address or otherwise misdelivered through no fault of the customer, Golden Hour shall provide an appropriate remedy.

Where sufficiently reliable evidence demonstrates correct delivery to the address supplied or approved by the customer, theft, unauthorized removal or loss occurring subsequent to correct delivery shall not automatically be classified as loss in transit. Any such matter shall be assessed individually by reference to the evidence and applicable law.

Damaged, Defective, Non-Conforming Or Incorrect Merchandise

Claims concerning transportation damage, manufacturing defects, incorrect merchandise, incomplete merchandise or merchandise materially inconsistent with the order shall be governed by the Return and Refund Policy.

The customer should retain the merchandise, external packaging, internal packaging, shipping label and such photographic or documentary evidence as may reasonably be relevant until Golden Hour has completed its review.

Merchandise must not be returned to an address printed on the package unless Golden Hour has expressly designated that address as the authorized return destination.

A supplier, manufacturer, fulfillment facility or carrier address appearing on a package may be incapable of receiving or processing customer returns. An unauthorized return may consequently be refused, lost or incapable of attribution to the relevant order.

Extraordinary Events And Operational Impediments

Fulfillment or delivery may be prevented, interrupted or delayed by events outside Golden Hour’s reasonable control, including natural disasters, severe weather, governmental action, customs intervention, transportation interruption, war, terrorism, civil disorder, public-health emergency, labor dispute, widespread carrier failure, infrastructure outage or other extraordinary impediment.

Where such an event affects an order, Golden Hour may communicate updated information, revise a non-guaranteed projection, provide a cancellation option or make available another remedy required by applicable law.

No provision of this section shall be construed as eliminating a mandatory obligation to issue a delay communication, permit cancellation, provide a refund or afford another non-waivable statutory remedy.

Limitation And Exclusion Of Certain Damages

To the maximum extent permitted by applicable law, Golden Hour shall not be liable for indirect, incidental, special, consequential, exemplary or punitive losses arising solely from a non-guaranteed processing, shipment or delivery delay.

Without limitation, excluded loss may include loss allegedly associated with:

a missed ceremony, holiday or social event;

altered or cancelled travel;

inability to use merchandise on an anticipated date;

loss of opportunity;

loss of business;

reputational harm;

emotional inconvenience; or

expenditure independently incurred in reliance upon a non-guaranteed delivery projection.

The foregoing limitation shall not exclude or restrict:

a refund required by applicable law;

a replacement or other mandatory statutory remedy;

liability for fraud or willful misconduct;

liability for gross negligence where such liability cannot lawfully be excluded;

any non-waivable consumer right; or

any liability otherwise incapable of lawful limitation.

Amendment, Severability And Temporal Application

Golden Hour may amend this Policy from time to time in order to reflect changes in its fulfillment arrangements, logistics network, carrier relationships, website functionality, commercial practices or legal obligations.

Unless applicable law requires otherwise, the version ordinarily applicable to a transaction shall be the version made available when the relevant order was submitted.

No subsequent amendment shall operate retroactively so as to deprive a customer of a right or remedy that had already accrued under a prior version or applicable law.

Where a provision of this Policy is determined to be invalid, unenforceable or inapplicable in a particular jurisdiction or circumstance, that provision shall be construed, limited or severed only to the minimum extent necessary. The remaining provisions shall continue in effect to the fullest extent permitted by law.

No failure, delay or omission by Golden Hour in exercising or enforcing any contractual right shall constitute a permanent waiver of that right or of any other right.
